Overview

These terms and conditions have been created for Paying and None paying subscribers as well as for all general website visitors.

All website visitors and subscribers must read and agree to these terms and conditions including any linked attachments that also form part of these terms and conditions, prior to using this platform.  

Compliance with these conditions is the website user's responsibility. Please read our Website Disclaimer prior to accessing this website platform.

 

Definition of Terms

The following list are definitions of our terms used in these terms and conditions:

  • Services - Those services that are made available to subscribers by Dog Friendly Scotland from time to time as part of subscribers benefits.
  • Listing - A web page or web pages on our website and other websites that host photographic and descriptive information regarding your holiday accommodation or other type business on offer to the general public. This information is viewed and fully searchable by the public.
  • Agreement – A bound agreement between you and Dog Friendly Scotland.
  • Us, We - Refers to Dog Friendly Scotland
  • You, Your - Refers to the subscriber/website visitor
  • Visitors - Refers to general website visitors looking to book accommodation or purchase any other product or service.
  • Platform or website refers to DogFriendlyScotland.com

Website Disclaimer

The website Disclaimer forms part of these terms and conditions, and therefore all subscriber and non-subscribers will comply fully with this disclaimer.

Website Visitors

All website visitors should familiarise themselves with our "Website Disclaimer Policy, Privacy Policy, Cookie Policy as well as the general terms in these terms and conditions.

Cooling Off Period

We offer a 14 day cooling off period for new listing subscribers, effective from the day your application is accepted.

We have the right to charge a proportion of the subscription fee for the time your account is active and a setup administration fee of £35 if you wish to cancel during the cooling off period.

If you wish to cancel your new subscription, you must notify us within the required time in writing, by letter or email to info@dogfriendlyscotland.com

Listing Subscription Application, Security & Verification

Dog Friendly Scotland subscription registrations follow a stringent process before acceptance is granted. We will aim to complete verification within three days, though there may be times when this is not possible, due to information requirements. If we cannot complete this process within the guide times, we will advise you of this by email. We may ask you to submit further information to conclude our checks.

We take the security of account openings very seriously. To eliminate any possibilities of accounts being opened fraudulently, you grant us the right to use your information with the reference agencies we use to verify your information is correct. If we have reason to believe that someone is attempting to open an account illegally, all information will be passed to the police for investigation.

If for any reason we are unable to accept your subscription application, we will advise you by email where you will receive a full refund. A supplement may be payable if the cost to confirm your property and person identity is out with our normal cost structure. We will advise you if there is an additional fee and you will be given the opportunity if you wish to proceed.  

As a subscriber, you grant Dog Friendly Scotland and its agents the right to visit your property to verify its existence when relevant notice has been given and dates/times agreed by both parties, whilst your subscription is active.

Listing Subscription Cancellation and Renewal

A listing subscription is a rolling agreement which will automatically renew upon the anniversary of your application.  You will receive a renewal notice in advance of the subscription renewal date, informing you of your renewal, your entitlement to cancel and of any changes to your payment details.  Any payment arrangements that have been made by Direct Debit or Credit Card will automatically continue unless you notify your bank/building society that you wish to cancel it.

If you wish to cancel your subscription, you must inform us of your intention to cancel a minimum of thirty (30) working days prior to your subscription renewal date. This notice should be provided directly to us, in writing by letter or email.

It is your responsibility to ensure that we have your most up to date correspondence address at all times. Failure to do so could result in the automatic collection of payment from your bank account or credit card without you having received the renewal notice, leading the way to unexpected payments and or charges coming from your account. We will not be held responsible in any way for bank charges related to the automatic payment of your subscription.

You may cancel your subscription at any time after the cooling off period, though no refunds will be provided regardless of reason.

Suspension or Termination

We reserve the right to suspend or terminate the subscription at any time and for any reason. Any violation of these terms and conditions or any reputation risk to us for what so ever reason would be deemed sufficient foundation for suspension and possible termination of subscription on the conclusion of any enquiry or investigation.

Where termination of subscription is the outcome, no refund will be offered.

Your Listing Information

A subscribers listing page/s must be compliant at all times with accurate and relevant information. It is your responsibility to ensure your listing page/s contains only the most up to date and accurate images, descriptions, prices and any other information offered on their page. Information that is not up to date could be classed as misleading. 

Failure to update your listing page/s would prove cause for the page or pages removal from the site either temporarily or permanently. 

We will from time to time ask you to log in to your subscriber account and sense check the information you have provided on your listing page/s to ensure it is still current, up to date and accurate and to ensure you continue to monitor the use of your listing page. Failure to act on these account checking requests will assume the account is not being monitored and will be suspended until we hear from you.

 

Subscription Fees

We reserve the right to make changes to the price of subscription charges on an annual basis. We will inform you in advance through your renewal notice of the current price for your subscription renewal.

Special promotions may be offered from time to time and will be available for a limited time only. Special offer promotions may carry additional offer terms and conditions which will be made available during the promotional period.

Introductory sign-up promotions that offer a discounted subscription rate will be available for the initial period of the offer after which the standard subscription price will apply for the product that has been purchased.

Subscribers Features and Benefits

Subscriber’s features and benefits may be subject to change, suspension or withdrawal at any time. We will advise the subscriber of any changes by email or text. Where possible, we will always advise in advance of any changes in the subscription offering. Where we have advised the date or timeline launch of a new subscriber feature or improvement and are subsequently delayed or changed or cancelled, we will not be held liable.

Intellectual Property

The website and all that it contains in its entirety is subject to copyright law. No such copy shall be made for any such reason of any part of the website or the service offering. Any violation of this part of this agreement will result in legal enforcement where a criminal conviction may be the outcome.

Use of Branded Assets

We grant the use of the Dog Friendly Scotland Icon trust badge to active subscribers only, to use in its online format and also our window sticker format as a visual acknowledgement that the subscriber's accommodation/business is dog-friendly.

The issued Icon trust badge window stickers should not be used for any other purpose than to be placed in the window of their accommodation/business of which address is registered in our database.

The online Icon trust badge should only be used to attract guests/customers to the subscriber's accommodation/business on its own website or their own registered social media profiles.

If a subscription ends and is not renewed or is terminated or is cancelled, all uses or representations of the Icon trust badge as described above must be removed with immediate effect.

We prohibit the use of the Dog Friendly Scotland Icon trust badge for any other use than described above. To use the Icon trust badge for any other use requires our written permission.

The Dog Friendly Scotland logo and Icon trust badge are protected by Trademark Law.   

Proprietary Rights

You grant to us an irrevocable, non-exclusive and royalty-free right and license (but not obligation), in perpetuity throughout the world, to use, copy, perform, reproduce, promote, publish, display and distribute any intellectual property and all copyright, in and to, each and every photograph, video, and all information related to your Listing. You grant these rights to us free of charge and without any commitment or recourse to us.

If you fail to renew or cancel your subscription at any time you must remove all Dog Friendly Scotland branding you may have been given permission to use under the agreement as all such agreement would end if your subscription is not active. 

You are responsible for determining whether content or information is protected by copyright, trademark, trade secret, right of publicity or other proprietary right. Except for that information which is in the public domain or for which you have been given express written permission you agree not to upload, post, or otherwise transmit any content or information protected by copyright, trademark, trade secret, right of publicity or other proprietary right without the express permission of the owner. You shall be solely liable for any damage resulting from any infringement of copyrights, trademarks, trade secrets, rights of publicity or other proprietary rights or any other harm resulting from such a submission.

Legal and Compliance

It's your legal responsibility to ensure that you have all relevant – permits, licences, certificates, guarantees, insurances in connection to environmental, health and safety, local and governmental laws in the country where your property is located to operate it as an accommodation business or business service or supplier in any context.

It's your legal responsibility to display any relevant information (e.g. business/tourist/property licence numbers) or on your listing/s as dictated by law in the country/region where your property is located.

Eligibility

Eligibility for subscription requires that you must:

  • Be aged 18 years or older
  • Be the owner of the accommodation property/business/service Or are the business manager with permissions to enter into such agreements as is bound by these terms and conditions.
  • Only list accurate photo’s and descriptions  
  • Have all reasonable means to prove: you are the owner of the accommodation/business/service Or are the registered manager of the company you are representing to register on the platform
  • Have a valid credit or debit card to pay online for your subscription
  • Agree to be bound by these terms and conditions in full while your membership is in force

Visitors Use of the Website

We provide this website as a vehicle in which business owners of all descriptions, related to the core of our advertising activities, can use to advertise their products and services.

We elect to instruct and advise through these terms and conditions to our subscribers, that they ensure at all times, that all the information they provide on their listing page for public viewing is up to date and accurate at all times.

Any arrangements, contracts and agreements are provided directly by the supplier listed on this platform to you the consumer or purchaser. In conjunction with our website disclaimer and these terms and conditions, we will not be held responsible for any inaccuracies, disputes or violations between subscribers and non-subscribers.  

Event Advertising

Conditions of advertising on our platform are as follows:

  • Event submission forms must be completed in full 
  • Logo/images uploaded must be Jpeg or Png format and to exact sizes
  • Events must be paid in advance of the event being live on our platform
  • Event content that requires to be updated after posting may carry a supplement and will be advised on prior to any changes made.
  • We have the right to refuse or remove advertising to the platform

From time to time promotional advertising offers may be available and may carry extra conditions relating to the offer in question. These will be made available to the party submitting the offer prior to acceptance of any advert advertising request and will be available to view whilst said the promotion is in force.

We may advertise events on the platform for awareness purposes only. These event adverts may not have been instructed by the event promoters and advertisers.

Events which we have added for awareness purposes carry the following notification - This event has been added for our website visitors general information on events available around UK and Europe that may be of interest. This event has not been added by the official event organisers. Whilst we make every effort to keep our information up to date, public information is constantly changing and therefore, no responsibility will be accepted if this information becomes out of date or which warrants this information to be inaccurate. 

Privacy Policy

All members are required to comply with our privacy policy at all times.

Indemnification

You agree to indemnify and hold harmless Accomadopg, its officers, directors and agents, from any injury or damage suffered directly or indirectly as a result of your use of your property, including but not limited to:

(i) any claims for injury or damage to person or property arising from a property you own; (ii) any claims for injury or damage to person or property arising from a property transaction to which you are a party; (iii) a violation of the Terms and Conditions of Use by you or anyone using your computer (or account, where applicable); (iv) a claim that any use of the Service by you or someone using your computer (or account, where applicable) infringes any property right of any third party; (v) any misrepresentation by you; or (vii) any breach of any Agreement to be performed by you.

You agree to pay any and all costs, damages and expenses, including, but not limited to, reasonable solicitors fees and costs awarded against or otherwise incurred by or in connection with or arising from any such claim, suit, action or proceeding attributable to any such claim, regardless of jurisdiction.

Disputes

We will not be held responsible for any events that occur as a result of any relationship between subscribers using features and benefits supplied by us. Any disputes arising from the use of subscriber’s benefits supplied by us should be settled between the parties who directly participated in the benefit.

Subscribers shall settle disputes arising out of or relating to the use of such features and benefits by amicable discussion. If this is unsuccessful, the management may volunteer to assess the arguments of the subscribers and make suggestions for settlement, but it has no obligation to do so and any recommendation by us has no binding authority; provided, however, the subscriber may choose to terminate a subscription after assessing a dispute in its sole and absolute discretion.

In the event of a termination of a subscription due to a dispute, we have no obligation to offer a refund. We do not assume any responsibility for subsequent resolution or failure to resolve.

Rights to Assign

A subscription of DogFriendlyScotland.com cannot be assigned, transferred or otherwise.

Insurance

It is the responsibility of the subscribing accommodation/business owner to ensure that they have adequate insurance coverage in place that protects: Buildings, Contents,  personal injury, indemnity, public liability, business failure and any other such insurances required for their accommodation/business.

Expectation of Privacy

To be wholly transparent at all times, rental home/accommodation owners or other business owners that use any kind of CCTV, recording device or other for reasons of security or other, must advise their guests/customers, show specific details on their property/business listings and also advise in their own booking terms and conditions if any devices are used.

Anyone person demands a right to privacy. There are laws guarding the public on this subject and it is your responsibility to ensure you are fully compliant.

Force Majeure

Neither party shall be liable to the other for any delay or non-performance of its obligations by reason of matters beyond its control including, but not limited to, any act of terrorism, war, riot, civil commotion, compliance with any law or government order, fire, flood or storm, strikes, or any other industrial dispute, delay in transit, power failure, postal delay, or any event that cannot be reasonably planned for or avoided.

In which case, we will deliver as soon as is reasonably possible.

LIMITATION OF LIABILITY

To the fullest extent permitted by applicable laws, none of Dog Friendly Scotland nor any of their respective directors, employees, affiliates or other representatives will be liable for loss or damages arising out of or in connection with the use of, or inability to use, the materials in and/or facilities or services offered through this website.

This includes but is not limited to, indirect or consequential loss or damages, loss of data, income, profit or opportunity, loss of or damage to property and claims of third parties, even if we have been advised of the possibility of such loss or damages or such loss or damages were reasonably foreseeable.

If this clause is unenforceable in whole or in part in any jurisdiction due to relevant laws, then in no event shall Dog Friendly Scotland’s total liability to you for all damages, losses, and claims (whether in contract, tort (including, but not limited to, negligence), or otherwise) exceed the amount paid by you, if any, for accessing this website or any services connected with it.

Agreement

While your membership is in force, you agree to be bound by these terms and conditions. These terms and conditions may be subject to change or modification.

If we modify these terms and conditions of this agreement, we will advise accordingly.
